POD Terms and Conditions

In these Terms and Conditions (unless otherwise stated):

  • "The POD" means "Property Owners Directory Limited"
  • "The website" means "the Property Owners Directory website" (www.propertyownersdirectory.com), owned by Property Owners Directory Limited.
  • "The Advertiser" means the person contracting to use this website to advertise their goods or services either by a listing or through a banner advertisement or both.
  • "The Advertisement" means the website space the Advertiser agrees on with the POD by which it publicises its goods or services.
  • "The Copy" means the words and images contained within the advertisement.

By using the website you accept that you are entering into a contract with us based on these Terms and Conditions. If you do not agree to these Terms and Conditions you may not access the site and its resources and facilities.

The website

This website is published by Property Owners Directory Limited (UK incorporated Company Number 5086209).

All content appears under the POD's copyright and may not be reproduced without permission. The only exception to this is the Advertiser's own logos, advertisements and wording.

The POD reserves the right to modify, restructure, redesign, or otherwise change the website at any time and without prior notice.

The Advertiser warrants that it will protect any passwords that may be provided giving access to pages and will not disclose these to third parties or otherwise allow unauthorised access.

The Advertiser accepts that the website may have periods of maintenance, repair or upgrading during which it will be unavailable. As far as is reasonable, the POD will endeavour to keep such periods to a minimum.

Content contained on the website applies only to the UK (e.g. in legal and tax matters) and is intended only for use in the UK. Website content is intended for information only, and the POD accepts no responsibility for loss arising from action taken having read the legal, tax or any other advice on the website.

The POD will endeavour to promote the website to the benefit of advertisers, but makes no guarantees regarding the number of hits or quantity of business generated from the website. It reserves the right to make any decisions on marketing policy that it sees fit and to terminate any marketing campaigns commenced at the time of entering into contract with the Advertiser.

Reliance on information and news on the site

The information and news facilities on our site are provided in good faith, but no responsibility whatsoever is accepted by the POD for the accuracy of the information provided, nor do we accept any liability and responsibility arising from any reliance placed on these materials by any visitor to our site, or by anyone who may be informed of any of its contents. Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed.

All of the information provided is for general information only and is not intended to be advice to any specific person. If you require specific advice on any particular situation you should obtain your own legal or financial advice from independent solicitors or accountants.

Advertising booking/payment

Advertisements for named periods will be paid at the rate agreed at the time of booking. The POD undertakes to reserve the agreed space on receipt of a booking confirmation from the Advertiser. The booking confirmation constitutes a valid contract under English law. An invoice will then be sent to the Advertiser. Payment for advertising bookings where payment is not taken over the telephone is due 14 days from the date of receipt of the advertising contract.

The Advertiser must pay the amount invoiced in the manner specified in the advertising contract. In the event that payments due remain outstanding for more than 14 days, we reserve the right to suspend our service and to remove the relevant information from the website. Prices quoted are exclusive of VAT which, if applicable, will be added to your invoice. You must pay the full amount including VAT in this case. If the Advertiser fails to make any payment or installment due under the Agreement or any other contract between us, all sums already paid by the Advertiser can be kept and all amounts still owing remain owing.

In this event, the POD can, without prejudice to its other rights, terminate this Agreement. A cancellation fee then becomes payable by the Advertiser equivalent to 20% of the Advertisement cost plus VAT or any deposit paid, whichever is higher.

Interest at a rate of 1.6% per month will be applied to any amount unpaid after 30 days from the date of the signed advertising contract being sent to the POD (except in cases where the law prevents the POD charging interest). Any reasonable legal and administrative costs in recovering money owed by the Advertiser to the POD may be claimed.

The POD reserves the right to increase the advertisement and listing rates at any time or amend the contractual terms. All contracts are accepted on the understanding that a rate increase or other amendment becomes immediately operative on all outstanding appearances of an advert, and shall not be deemed a breach of contract. In such an event, the Advertiser has the option of canceling the balance of the contract without surcharge. In the case of listings, increases will take effect one year after the last annual payment has been made.

The Advertising copy

The POD agrees to publish the advertisement on the website in accordance with generally accepted publishing standards. It reserves the right to make any changes to the advertisement it deems necessary.

It is the Advertiser's responsibility to submit suitable advertising copy to the POD within the date the POD specifies. In the event that the Advertiser fails to do so, the POD will have the right to publish the Advertiser's name and address only or use copy already submitted by the Advertiser, and will not be held liable for any errors, mistakes or omissions therein.

It is the advertiser's responsibility to verify that information supplied to POD is correct and to inform the POD of any inaccuracies as soon as is reasonable.

The Advertiser warrants that it is the owner of all intellectual property rights in the copy provided to the POD and that it is authorised to permit the POD to use this copy on the Advertiser's behalf.

If the Advertiser wishes to change any part of the banner advert copy following its submission, it must inform the POD within 14 days of the date of the booking order. Listing changes can be made by the Advertiser online, and the advertiser takes full responsibility for the entries it makes.

No information given to the POD for advertising should breach another individual or corporation's legal rights; in agreeing to these terms and conditions, the Advertiser warrants that this is the case, and they will indemnify the POD against any loss in legal action arising as a result.

Advertisers and listers may not transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, pornographic, profane or otherwise objectionable material or information of any kind including but not limited to transmission constituting or encouraging conduct which would constitute a criminal offence, give rise to civil liability or otherwise violate any national or international law.

The POD reserves the right to refuse to publish or remove from its website at any time any information it reasonably believes to be a breach of copyright, untrue, inaccurate, libelous or obscene.

The POD reserves the right to refuse, amend, withdraw or otherwise deal with all advertisements and listings submitted to it at the company's absolute discretion and without explanation. All advertisements and listings must comply with the British Code of Advertising Practice.

Advertisers will ensure that material they provide to the POD has been produced using correctly licensed software and is free from all viruses, worms, Trojan Horses and other damaging computer code.

Errors and Omissions

Errors or omissions in banner advertisements will entail a full or partial refund being paid to the Advertiser depending on the nature of the error and the period of time the error was displayed.

If the mistake was apparent in any proof approved by the Advertiser, no refund is payable unless the proof was corrected before the specified date indicated on the proof approval form.

Cancellations

Prior to listings or advertisements appearing on the website, confirmed bookings for advertisements may be cancelled, in which event 50% of the agreed fee for the appropriate level of subscription will still be payable depending on the Advertiser's subscription rate.

In the absence of any cancellation by the advertiser, once a listing or advertisement has appeared on the site, it is deemed to have been published and the agreed amount is payable in full.

Marketing and Advertising

The POD will promote www.propertyowersdirectory.com for the benefit of advertisers but will do so at its discretion, and the POD makes no specific commitment to begin or continue any particular marketing campaign.

The inclusion of advertising on this site does not indicate that the POD endorses any particular product or service advertised, nor does the recommended icon (indicating that a property service provider has been able to provide at least two testimonials from satisfied customers) the endorsement of the POD itself.

While the POD requires recommended tradesmen to provide two or more testimonials in order to receive a recommended icon, we cannot guarantee the authenticity of the references supplied and POD does not vouch for or endorse any of the individuals and companies listed in its directory, and users of the directory are advised to personally confirm the professional qualifications, membership of trade bodies and references which property service providers refer to in their directory listing or on their own websites, if they feel this is necessary.

The POD will not be liable for any loss or damage resulting from use of our website, and the statements made in property service providers" directory entries, or from any loss or damage that results from any user of the site relying on comments or recommendations made by another user of the site, for example in the Forum section of the POD.

The Directory

The on-line directory is designed to assist landlords and property owners to find recommended tradesmen. It is not to be used to generate mailing lists on a commercial basis.

The POD website and all the information contained in it may not be used to construct a database of any kind nor may the POD be stored in its entirety or in any part in databases for access by you or any third party.

This contract will be subject to English Law and the jurisdiction of English Courts.
